1. Who we are
This website and online store (the “Store”) are operated by KEO LLC, which sells under the brand ALPAKA (“ALPAKA”, “we”, “us”, “our”), 1800 E 4th Street, Unit 250, Austin, TX 78702, USA. Orders ship from Pāhoa, Hawaiʻi. You can reach us through our contact page.
By visiting the Store or buying from us you agree to these Terms of Service (the “Terms”), together with our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms. If you don’t agree, please don’t use the Store.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. We sell to customers with shipping addresses in the United States only.
3. Our products
ALPAKA sells ceremonial cacao: a food product made from 100% cacao beans. We describe our products as accurately as we can, including ingredients, weight and origin. Because each block is made in small batches and wrapped by hand, colour, surface and shape can vary slightly from photos.
Our cacao is a food. Nothing on this Store is medical advice, and our products are not intended to diagnose, treat, cure or prevent any disease. Cacao naturally contains theobromine and caffeine. If you are pregnant, nursing, sensitive to caffeine, or take medication, consult your doctor before consuming cacao. Keep cacao away from pets.
Preparation suggestions, recipes and articles on the Store are for general information. Follow food-safety common sense when handling hot liquids.
4. Prices and payment
Prices are shown in US dollars and may change at any time without notice, but a change won’t affect an order we have already confirmed. Shipping costs and any applicable taxes are calculated and shown at checkout before you pay.
Payments are processed by Shopify and its payment partners. We don’t see or store your full card details.
5. Orders
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if a product is out of stock, if there is an obvious pricing or description error, or if we suspect fraud. If we cancel after you’ve paid, we’ll refund you in full.
Our batches are small. We may limit the quantity of a product per order or per customer.
When a batch sells out, we may offer pre-orders from the next batch. A pre-order reserves a block; your card is saved at checkout and charged when your parcel ships. The product page shows the current estimate (usually about 2–4 weeks), which is not a guaranteed date. You can cancel a pre-order at no cost any time before it ships, and if the batch runs late we’ll email you with a new estimate and the choice to cancel. See our refund policy and shipping policy.
6. Shipping, delivery and risk
We ship from Hawaiʻi to US addresses as described in our Shipping Policy. Delivery times are estimates. Title and risk of loss pass to you when the carrier delivers the parcel to your shipping address. If a parcel is lost or damaged in transit, we will help as described in our Refund Policy.
7. Returns and refunds
Returns, replacements and refunds are governed by our Refund Policy.
8. Wholesale and group inquiries
Submitting a wholesale or facilitator inquiry does not create an obligation for either side. Any wholesale supply will be agreed separately in writing.
9. Your use of the Store
You agree not to misuse the Store: no unlawful use, no attempts to break or overload it, no scraping in breach of our robots instructions, no reselling our content as your own, and no false information in orders.
10. Content and intellectual property
All text, photos, illustrations, logos (including our seal mark), and other content on the Store belong to ALPAKA or our licensors and are protected by copyright and trademark law. You may share links and quote short excerpts with credit. Any other use requires our written permission. Photos of people are published with their consent and may not be reused.
11. Reviews, comments and messages
If you send us reviews, photos, comments or ideas, you give us a non-exclusive, royalty-free right to use, reproduce and publish them in connection with ALPAKA, with credit where appropriate. Don’t send anything unlawful, misleading or that belongs to someone else.
12. Third-party links and services
The Store may link to other websites and uses third-party services (such as Shopify, payment providers and carriers). We are not responsible for their content or practices.
13. Disclaimer
Except as expressly stated in these Terms, the Store and our products are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms limits any rights you have under applicable consumer-protection law that cannot be limited.
14. Limitation of liability
To the fullest extent permitted by law, ALPAKA will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Store or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.
15. Indemnity
You agree to indemnify ALPAKA against claims arising from your breach of these Terms or your misuse of the Store.
16. Governing law
These Terms are governed by the laws of the State of Hawaiʻi, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Hawaiʻi County, Hawaiʻi, unless applicable law requires otherwise.
17. Changes
We may update these Terms from time to time. The version posted on the Store when you place an order applies to that order.
